1. General:
   1. The “Refer a Friend” referral program offers members the opportunity to earn a bonus for referring their family and friends to TopCashback USA. The program is governed by these Terms & Conditions (“T&Cs”) in addition to our standard Terms & Conditions.
   2. When promoting TopCashback using a referral link, make it clear that you’re participating in our Refer a Friend program and will receive a reward with every successful referral.
2. Eligibility:
   1. The referral program is open to all TopCashback USA members in good standing (i.e., your TopCashback account has not been restricted or deactivated).
   2. The referral program is intended for individuals to promote TopCashback to family and friends. We reserve the right to restrict referral bonuses or deactivate your account if we believe the program is being abused.
   3. If you promote or intend to promote TopCashback to a wider audience using the referral program, you’ll be bound by the additional terms in section 7.
3. How It Works:
   1. You’ll receive a referral bonus if:
      • Your referred friend clicks your unique “Refer a Friend” link and signs up for TopCashback through that link.
      • Your referred friend verifies their TopCashback account.
      • Your referred friend meets the Cash Back or spend requirement stated in the promotion’s Terms and Conditions.
   2. The referral bonus amount and qualifying time period are subject to change. The bonus you receive will be the amount advertised on the site at the time your friend signed up through your referral link. This may differ from the amount offered when you sent the link to your friend or when the bonus was credited to your account.
   3. The referral bonus you’ll receive and the deadline for your referred friend to meet the qualifying requirements will be shown on the Refer a Friend > View All Referrals page in your account.
   4. The referral bonus will become payable when your referred friend’s Cash Back is payable.
4. Exclusions and Limits:
   1. Referral bonuses will only be paid for genuine sign-ups. We will not pay a referral bonus if the new account has been terminated. Creating multiple accounts for the same person or submitting fraudulent sign-ups may result in the termination of your account and any accounts which we determine to be linked.
   2. You must not promote your referral link alongside any other new member incentives unless expressly permitted in the promotion’s Terms and Conditions. Referrals where more than one promotion has been earned for the same sign-up may have a bonus or incentive removed.
   3. Cash Back awarded as goodwill payments, incentives or contest winnings will not count toward meeting the qualifying requirements for either Refer a Friend sign-up bonuses or referral bonuses.
   4. The following transactions will not count toward your referred friend’s qualification requirements:
      • Additional sign-up bonuses
      • Bonus promotions
      • New member deals
      • Cash Back awarded from the excluded retailers listed in section 8 at the time the new member signed up
5. Representations:
   1. By participating in the referral program, you represent and warrant that:
      • When sending a direct message or email, you have, where reasonably practical, obtained the referred person’s consent to receive that type of marketing communication.
6. Prohibited Activities:
   1. The following activities are not permitted:
      • Impersonation of TopCashback or claiming to represent TopCashback, including making false claims about any rewards that may result from signing up.
      • Referring yourself (self-referral).
      • Using your referral link in search engine sponsored listings (e.g., Google Ads) or any other paid advertising without the prior permission of TopCashback.
      • Using iframes to generate referrals unless expressly permitted by TopCashback.
      • Misleading, or attempting to mislead, anyone in connection with the Refer a Friend referral program.
7. Posting in Public (Including by Influencers):
   1. If you’re a content creator or influencer, you should consider registering for our separate affiliate program - www.topcashback.com/dyn/affiliate-program/.
   2. The following additional terms apply if you promote, or intend to promote, TopCashback via the Refer a Friend referral program to a wider audience (e.g., on forums, message boards, blogs or social media).
   3. If promoting TopCashback in a commercial capacity, you must comply with all relevant FTC requirements.
   4. If choosing to promote TopCashback on your own website:
      • You must provide a cookie consent mechanism, a Cookie Policy and a Privacy Policy that comply with all applicable laws and regulations.
      • You acknowledge and agree that TopCashback uses cookies to track referrals and correctly attribute referral bonuses. By including your referral link on your website, you consent to TopCashback recording referrals generated through your website.
      • You must only send Refer a Friend invitations by electronic communication (including email and direct messages) where you have obtained any consent required under applicable laws.
