TOPCASHBACK ‘BIRTHDAY BASH CASH BACK GIVEAWAY’ TERMS AND CONDITIONS
1. Eligibility
Entry to the TopCashback Birthday Bash Cash Back Giveaway (“Sweepstake”) is open to all TopCashback.com members aged 16 or over at the date of entry. Employees of TopCashback, their immediate family or anyone directly connected to the Competition Employees of TopCashback, their immediate family or anyone directly connected to the Competition or operation of the Competition are not eligible. Entrants need to be a member of TopCashback.com to enter.
2. Entry Period
The entry period for the Competition will open on November 14, 2016 at 12:01am PST and will close at 11:59pm PST on November 18, 2106. Entries received after that date will not be entered into the draw.
3. How To Enter
Entrants must have a TopCashback account in good standing. Entrants must be logged in to their TopCashback account to take part. Entrants must click through from a merchant page on TopCashback.com and make a purchase at one of the thousands of online stores affiliated with TopCashback.com. By clicking a “Get Cashback” button on any merchant page on TopCashback.com and making a purchase at the destination store, members are automatically entered into the Sweepstakes.
No purchase necessary. To enter without making a purchase, simply visit this page and leave a comment on the blog post stating your intent to enter. You can enter multiple times per day, but each entry requires a new blog comment.
4. The Prizes
All prizes are subject to terms and conditions. All prizes are non-transferable. The Promoter reserves the right to replace all prizes with alternatives should circumstances make this necessary.
25 Prizes (5 Daily) – Each daily winner will receive the cashback equivalent (up to $500) of a single transaction placed via TopCashback on that specific day during the Sweepstakes entry period. If the winner’s transaction exceeds $500, a maximum of $500 will be placed in the winner’s TopCashback account.
If a no-purchase-necessary entry is selected as a winner, $500 will be deposited into that member’s TopCashback account.
The 25 winners will be notified via a support ticket in their TopCashback Account within 48 hours of the prize draw close date. An email notification for this support ticket will also be sent to the winners' TopCashback.com registered email address. TopCashback.com reserves the right to offer the prize to another entrant should any winner fail to respond within 7 days.
Winners will be credited with the value of the prize amount directly into their TopCashback account. TopCashback endeavors to deliver the prize to the winner within 5 days from the date of winning the prize.
The Prize Draw Dates will begin on November 21, 2016 with a selection of 5 winners from the first competition day of November 14, and continuing daily through November 28. Winners will be chosen at random using the website Random.org to generate random numbers from our final list of transactions.
5. Acceptance by Entrants
By entering the Sweepstake, entrants accept these Terms and Conditions and agree to be bound by them and any subsequent decisions by the Promoter under these Terms and Conditions. Any entrant who enters or attempts to enter the sweepstake in a manner, which in TopCashback’s determination, is contrary to these terms and conditions or is fraudulent or unjust to other entrants (including without limitation tampering with the operation of the competition, hacking, cheating, deception, or any other unfair playing practices such as intending to annoy, abuse, threaten, or harass any other entrants or TopCashback and/or any of its agents or representatives), may be rejected from the sweepstake at TopCashback’s sole discretion. By entering the Sweepstake, entrants accept that the Promoter’s decision will be final. The winners agree to allow the Promoter to confirm their name, age and State of residence to other entrants via Facebook and any other medium.

6. Events Outside the Promoter’s Control
Events may occur which render the Sweepstake itself or the awarding of the prizes impossible due to reasons beyond the control of the Promoter and, accordingly, the Promoter may in its absolute discretion vary or amend the Sweepstake and entrants agree that no liability shall attach to the Promoter as a result thereof. TopCashback reserves the right to modify, cancel, terminate or suspend the Sweepstake in whole or in part, at its sole discretion, if it believes the Sweepstake is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of TopCashback that could corrupt or affect the administration, security, impartiality, or normal course of the Sweepstake.
TopCashback will not be liable for any failure of receipt of entries and takes no responsibility for entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.
7. Governing Law
Entrants agree that the Sweepstake is governed, interpreted and enforced by the laws of The United States of America and by entering, all entrants submit to the jurisdiction of the Courts of The United States of America.
8. Personal Information
Personal information provided by entrants will be used to administer the Sweepstake. The entrants agree that the personal information provided will be used by the Promoter to provide entrants with information about products or services that may be of interest to them. This may include information about other firms’ products although the Promoter will not disclose entrants’ personal information to any third party. The entrants may be asked, but are not under an obligation, to participate in non-paid publicity.
9. Details of the Promoter
TopCashback (USA) Inc (TopCashback) is a company registered in Delaware, USA, whose registered office is at TopCashback (USA) Inc., 3422 Old Capitol Trail, Ste 1701, Wilmington, Delaware 19808-6192 (“Promoter”).
This Sweepstake is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible entrants understand and agree that they are providing their information to TopCashback (USA) Inc. (TopCashback) and not to Facebook. By entering this competition, each eligible entrant releases Facebook from any action or claim arising out of the competition. Any questions, comments or complaints regarding this competition must be directed to TopCashback (USA) Inc. (TopCashback), not Facebook.
10. Additional Disclosure
The Birthday Bash Cash Back Giveaway is hosted by a server located in Ireland, EU and is available to only those entrants who’s jurisdiction allow cashback prizes to be received, any entrants in which their jurisdiction prohibits the aforementioned are void and prohibited.
